TERMS AND CONDITIONS  MAGILORE®

The Terms and Conditions are subject to change at any time without prior notice. For the latest version, please refer to our website. These conditions may be electronically saved or printed by any user of our website. As long as they remain published online, these terms apply to all transactions made through our website or via email at info@magilore.kids.

By placing an order, the customer agrees to accept the following Terms and Conditions:

PRICES

  • MAGILORE® reserves the right, without prior notice, to discontinue products or change product specifications and prices.

  • Prices always refer to a single unit and do not include VAT. Applicable taxes and legal fees must be added to the final price.

  • Prices are EX WORK from Portugal and do not include shipping, handling, or assembly services.

  • For upholstered items, prices include standard fabric. If the customer requires a different fabric from MAGILORE®’s collection, they must contact us for a price quote.

  • All prices are determined by an individual assessment of each customer.

TAXES

All taxes and duties of any kind, imposed by governmental authorities (federal, state, or local), directly or indirectly, on the sale or transportation of any goods, must be paid by the buyer.

PACKAGING

  • Packaging is included in the price.

  • If a wooden crate is required, the customer must specify this when placing the order.

  • If specific packaging is requested, the corresponding fee will be charged.

ACCOUNTS AND PAYMENT TERMS

  • Accounts will only be registered after the issuance of the first pro forma invoice.

  • The customer must provide valid company information: billing name, billing address, VAT number (or company registration number).

  • A credit application submitted by the customer will only be considered upon receipt of a resale certificate. In this case, open account terms are not automatically applicable.

  • Open credit terms will be evaluated case by case after the first formal order.

  • Pro forma orders require a 50% deposit at the time of order, with the remaining 50% due before shipping (no later than 3 days before expedition).

  • Customized pro formas or orders above USD 100,000 with discounts require a 100% deposit.

  • Payments must be made via bank transfer in euros or dollars, with confirmation sent by email to info@magilore.kids.

  • Pro forma invoices must be signed and stamped by the customer as confirmation of acceptance.

  • All pieces remain the property of MAGILORE® until full payment is received.

  • MAGILORE® reserves the right to postpone shipment until the balance has been received in full.

PRODUCT AND STORAGE FEES

  • MAGILORE® reserves the right to apply a storage fee unless otherwise agreed by both parties.

  • Upon completion, a 10% weekly storage fee will be charged for any items stored if the invoice balance is not paid and shipping has not been arranged within 2 weeks of readiness.

  • This fee is cumulative until the full invoice balance and storage fees are paid, and shipment is arranged.

PRODUCT CUSTOMIZATION

  • MAGILORE® can customize existing products or create bespoke items. All customizations are subject to an upcharge.

  • Special pricing based on quantity and features will be provided upon request, case by case.

  • A non-refundable design fee may be charged for additional drawings or renders requested for customized products. This fee will be deducted from the final order cost.

LEAD TIMES

  • All quoted completion and delivery dates are estimates only.

  • Production time is typically 12 to 14 weeks, depending on the product category.

  • For custom specifications or large quantities, MAGILORE® may set a different lead time.

  • Lead time for non-standard orders starts once the fabric arrives properly identified at our office.

  • MAGILORE® is not responsible for production delays due to improperly identified fabrics or delayed transfer confirmation.

FORCE MAJEURE

MAGILORE® shall not be liable for delays caused by circumstances beyond reasonable control, including but not limited to government actions, war, embargoes, raw material shortages, labor strikes, natural disasters, or other force majeure events.

Acceptance of goods constitutes a waiver of any claims for damages due to delayed delivery.

FREIGHT POLICY & DAMAGE CLAIMS

  • Transportation arranged by MAGILORE® is charged separately. White glove service is not included unless stated.

  • Once collected by the carrier, goods are the responsibility of the purchaser.

  • MAGILORE® is not responsible for transit loss or damage. Customers must file claims directly with the carrier and notify MAGILORE® within 5 business days, providing photographic evidence.

  • Claims outside this timeframe will not be accepted. Replacement will only cover the affected part/piece, upon agreement.

  • If the customer arranges transport, MAGILORE® bears no liability for transit issues.

RETURN AUTHORIZATION

  • MAGILORE® does not accept returns by default. Authorization is at MAGILORE®’s sole discretion.

  • Unauthorized returns will be refused at the buyer’s expense.

  • Items must be returned in original condition and packaging, with all costs prepaid by the client.

  • 50% deposits are non-refundable. Custom items cannot be returned under any circumstance.

ORDER POLICY

  • Orders must be placed via email with purchase order number and client details.

  • Order confirmation will be issued within 3 business days. Production begins after confirmation and a 50% deposit.

  • Cancellations are not accepted after 5 business days from confirmation. Paid amounts will be credited as a Credit Note.

  • All changes, returns, or cancellations require prior written approval. Cancellation fees up to 40% of net price may apply.

CUSTOM ORDERS

  • Require special pricing and may include non-refundable design fees.

  • Lead times may be extended.

  • Custom orders cannot be returned under any circumstance. If approved specifications are met, the order is binding.

CONTRACT / HOSPITALITY ORDERS

MAGILORE® can customize or develop products for contract projects. These require tailored pricing. Please contact us for detailed quotes.

CODE COMPLIANCE

MAGILORE® does not guarantee compliance with local building codes. It is the buyer’s responsibility to ensure conformity.

INTERNET POLICY

  • Reseller websites may not use MAGILORE®’s name, logo, images, or branding without prior written consent.

  • Prices, promotions, or discounts below standard retail may not be advertised online. Contact MAGILORE® for internet use guidelines.

DISTRIBUTION POLICY

MAGILORE® reserves the right to refuse or discontinue sales to any reseller whose practices negatively affect brand positioning.

PRODUCT

  • All MAGILORE® pieces are handcrafted. Minor variations may occur.

  • MAGILORE® may improve product designs without notice. Images on catalogues/website may differ slightly from final products.

  • Custom requests are subject to design team approval and may involve fees.

CLEANING & CARE

  • Use a clean, soft, lint-free cloth (cotton or microfiber) to remove dust.

  • Do not use abrasive sponges or harsh cloths.

  • Only use water-based cleaning agents when necessary.

STOCK

MAGILORE® maintains a reasonable inventory for immediate shipment. Contact our sales team or visit our website for the Ready to Ship list.

WARRANTY & DISCLAIMER

MAGILORE® products are not covered by warranty. MAGILORE® reserves the right to determine whether repair or replacement is appropriate.
