TERMS AND CONDITIONS – MAGILORE
The Terms and Conditions are subject to change at any time without prior notice. For the latest version, please refer to our website. These conditions may be saved electronically or printed by any user of our website. As long as they remain published online, these terms apply to all transactions made through our website or via email at info@magilore.kids.
By placing an order, the customer agrees to accept the following terms and conditions:
PRICES
- MAGILORE reserves the right, without prior notice, to discontinue products or change product specifications and prices.
- Prices always refer to a single unit and do not include VAT. Applicable taxes and legal fees must be added to the final price.
- Prices are EX WORK from Portugal. They do not include shipping, handling, or assembly services.
- For upholstered items, prices include standard fabric. If the customer requires a different fabric from MAGILORE’s collection, they must contact us for a price quote.
- All prices are determined by an individual assessment of each customer.
TAXES
- All taxes and duties of any kind, imposed by governmental authorities (federal, state, or local), directly or indirectly, on the sale or transportation of any goods, must be paid by the buyer.
PACKAGING
- Packaging is included in the price.
- If a wooden crate is required, the customer must specify this when placing the order.
- If specific packaging is requested, the corresponding fee will be charged.
ACCOUNTS AND PAYMENT TERMS
- All accounts will only be registered after the issuance of the first pro forma invoice.
- The customer must provide valid company information: billing name, billing address, VAT number (or company registration number).
- A credit application submitted by the customer will only be considered upon receipt of a resale certificate. In this case, open account terms are not automatically applicable.
- Open credit terms will be evaluated on a case-by-case basis after the first formal order.
- Pro forma orders require a 50% deposit at the time of the order, and the remaining 50% must be paid prior to shipping (no later than 3 days before the expedition date).
- Customized pro formas or orders above USD 100,000 with discounts require a 100% deposit.
- Payments must be made via bank transfer in euros or dollars, with confirmation of the transfer sent by email to info@magilore.kids.
- Pro forma invoices must be signed and stamped by the customer as confirmation of acceptance.
- All pieces remain the property of MAGILORE until full payment is received.
- MAGILORE reserves the right to postpone the shipping date until the full balance has been received.
PRODUCT AND STORAGE FEES
- MAGILORE reserves the right to apply a storage fee unless otherwise agreed by both parties.
- Upon completion, an additional storage fee of 10% per week will be charged for any items stored, if the invoice balance is not fully paid and shipping arrangements have not been made within 2 weeks from the date the goods are ready.
This fee is cumulative until the total invoice balance and storage fees are paid in full and shipment is arranged.
PRODUCTS CUSTOMIZATION
- We have the ability to customize existing products or to make new products (bespoke) to meet your desire/need – all situations that require custom designs are subject to an upcharge. Special pricing based on quantity and features will be provided upon request for all customized products – the decision will be made on a case-by-case basis and the Buyer will be notified of any said fees.
- Before any order, we are free to charge a design fee for more extensive drawings or renders the client may request for customized products. These fee are non-refundable once paid for and will be deducted from the final cost of the order.
LEAD TIMES
All quoted completion and delivery dates are estimates only.
Production time is between 12 and 14 weeks, depending on the product category.
For pieces with custom specifications or large quantities, MAGILORE reserves the right to agree with the client on a different lead time.
Lead time for orders with non-standard products starts once the fabric arrives at our office and is properly identified.
All fabrics must be properly identified with the respective document.
MAGILORE is not responsible for production or any product delay if the fabric is sent without proper identification.
MAGILORE is not responsible for delay in production time due to delay in transfer confirmation.
FORCE MAJEURE
All quoted completion and delivery dates are estimates only.
Manufacturer shall not be liable for delays in completion or shipment or default in delivery due to any cause beyond the manufacturer’s reasonable control, including but not limited to: (a) government actions, war, riots, civil unrest, embargoes, or laws; (b) inability to obtain necessary materials from usual sources; (c) shortages of labor, raw materials, production or transportation facilities; (d) labor difficulties involving manufacturer’s employees or others; (e) fire, flood, or other casualty; or (f) any other events beyond manufacturer’s control. In any such event, MAGILORE shall have additional time as reasonably necessary to perform.
Acceptance by the buyer of any goods shall constitute a waiver of any claims for damages due to delay in delivery.
FREIGHT POLICY & DAMAGE CLAIMS
Transports arranged by MAGILORE are assessed separately from the product(s) value. White glove service is not included unless explicitly stated. All products are carefully packed and inspected prior to shipment.
The waybill is assigned to the purchaser once the goods are picked up by the carrier. Refusing damaged merchandise does not release the client from payment responsibility.
MAGILORE is not responsible for loss or damage in transit. In case of visible or concealed damage, the client must immediately notify the carrier and file a claim.
All damage must also be reported to MAGILORE within 5 working days of receiving the order, with photographic evidence sent by email to info@magilore.kids.
Claims not reported within five days of receipt will be denied. If the damage requires replacement, MAGILORE will replace only the affected part/piece, upon agreement.
If the client chooses to use their own transportation method, MAGILORE shall be free of any charges or responsibility for what may occur during transport.
RETURN AUTHORIZATION
MAGILORE does not accept returns by default. It is at MAGILORE’s sole discretion to authorize the return of merchandise.
Items returned without prior authorization will be refused at the buyer’s expense.
Returned items must be in their original condition and packaging. The client must prepay and assume all costs, including insurance, for the return shipment.
The 50% deposit is non-refundable. Custom items are not eligible for return under any circumstance.
ORDER POLICY
Orders should be submitted via email. All orders must be placed in writing, including a purchase order number and the client’s name.
An order confirmation will be sent within 3 business days via email. Merchandise is manufactured upon receipt of the order confirmation and a 50% deposit.
Cancellations will not be accepted more than 5 business days after the order confirmation date. The paid amount will be credited by MAGILORE as a Credit Note to the original ordering entity.
Changes, returns, or cancellations require prior written approval from MAGILORE. In all cases of modification, loss of project, etc., amounts already paid will not be refunded or credited, and the client forfeits all rights to the goods.
Such cases are subject to change or cancellation fees up to 40% of the net selling price.
CUSTOM ORDERS
These orders require special pricing based on quantity and custom features.
All custom designs are subject to a non-refundable design fee plus any customization charges. In specific cases, additional design fees may apply, which will be communicated to the client.
For items with custom specifications, MAGILORE reserves the right to extend the standard lead time.
Custom orders are not returnable under any circumstance. If a custom order is accepted, it is produced correctly and in accordance with the approved specifications. MAGILORE reserves the right to repair or replace any item with production issues, upon prior discussion with the client.
CONTRACT/HOSPITALITY ORDERS MAGILORE has the ability to customize existing products or develop new ones to meet specific contract requirements. These orders require special pricing based on volume and features. Please contact MAGILORE for detailed contract quotes.
CONFORMIDADE COM O CÓDIGO A MAGILORE não faz nenhuma representação de que seus produtos estejam em conformidade com qualquer ou todos os códigos de construção locais. É responsabilidade do comprador determinar a conformidade com o código local.
POLÍTICA DE INTERNET
Os sites dos revendedores não podem anunciar, nem exibir de nenhuma forma, o nome, logotipo, imagens de produtos ou materiais de marca da MAGILORE sem o consentimento prévio por escrito da MAGILORE.
Os sites de revendedores podem não exibir preços, ofertas promocionais, descontos ou declarações de valor abaixo do preço de varejo padrão. Entre em contato com a MAGILORE para obter diretrizes de uso da Internet.
POLÍTICA DE DISTRIBUIÇÃO A MAGILORE reserva-se o direito de recusar ou descontinuar vendas a qualquer revendedor cujas táticas de distribuição ou vendas afetem negativamente o posicionamento da marca ou a presença de mercado da MAGILORE.
PRODUTO
Cada peça MAGILORE é feita à mão. Embora todos os esforços sejam feitos para manter a uniformidade, pequenas variações podem ocorrer.
A MAGILORE é livre para melhorar qualquer design de produto sem aviso prévio. As imagens do catálogo e do site podem variar do produto final. Nós nos esforçamos para melhorar continuamente a qualidade, usabilidade e confiabilidade do nosso produto.
Para solicitações personalizadas, cada caso será avaliado por nossa equipe de design. Uma taxa pode ser aplicada para desenhos personalizados.
LIMPEZA E CUIDADOS
Oferecemos as seguintes dicas de cuidados para ajudar você a preservar seus móveis nas melhores condições possíveis.
Use um pano limpo, macio e sem fiapos (por exemplo, algodão ou microfibra) para remover a poeira. Não use esponjas abrasivas ou panos ásperos. Use apenas agentes de limpeza à base de água quando necessário.
